Melrose II fund sues Paramount over profits

The Melrose II fund co-financed several Paramount pics, including the 'Transformers' franchise.Investors in Melrose II, a fund which co-financed Paramount pics including the "Transformers" franchise, have sued the studio over profits to several films. Filed today in Los Angeles Superior court, the suit seeks to recover profits related to a nearly $375 million investment in 29 films dating back to 2006. Suit, which also name DreamWorks as a defendant, points to pics including "Mission Impossible 3," "Charlotte's Web," "Dreamgirls," "Flags of Our Fathers," "Blades of Glory," "Jackass 2" and all three "Transformers" films. While the lawsuit does not specify a dollar amount, the contested money is believed to total in the tens of millions. Documents allege that since inking a deal with the studio five years ago, financiers have not yet seen a profit on their investment. The complaint alleges that those investors were entitled to a a 25% copyright interest in up to 30 films and agreed to fund a "pro rata" amount of the production costs. "Melrose II is an important investor and copyright owner and we're going to fight to make sure that they get their fare share of these profits," Kirkland & Ellis LLP's Mark Holscher told Variety. The firm is representing the Melrose II group, which is mainly comprised investors based in NY. "On Melrose Avenue, at the oldest existing film studio in Hollywood, Paramount Pictures Corporation routinely calculates 'net receipts' to take in huge returns on one set of books while reporting losses to its profit participants on another," the suit alleges. This is not the first time investors have accused the studio of Hollywood accounting. In 2008, a number of investors from the studio's Melrose I financing vehicle sued the studio for securities fraud and are currently seeking about $30 million in damages. Paramount did not have an immediate comment. Contact Rachel Abrams at Rachel.Abrams@variety.com

Moody's: TV Station Groups Face Financial Threat from Networks

Lawyers representing the convicted assassin of Robert F. Kennedy hope to prove their client's innocence... 43 years later. In newly filed court documents obtained by the AP, Sirhan Sirhan's legal team allege that a bullet was switched in evidence at his trial, and that Sirhan was hypnotized to fire shots as a diversion from the actual killer. The lawyers, William F. Pepper and Laurie Dusek, also claim that new audio tests from the 1968 assassination prove that there were 13 shots fired from multiple guns -- five more than Sirhan could have fired from his pistol. In the original trial, eight bullets were counted. Three hit Kennedy, and the rest struck five other victims who were able to recover. PHOTOS: 12 of Hollywood's Most Mysterious Deaths The shooting occurred at L.A.'s Ambassador hotel on June 5, 1968, as the Senator was celebrating his victory in the California and South Dakota primary elections for the Democratic nomination of President. Kennedy was fatally wounded as he walked through the hotel's kitchen on his way to the exit. He survived nearly 26 hours after the incident, dying on June 6 at the Good Samaritan hospital, where he had been treated with surgery. With Kennedy that night was friend and actor/writer George Plimpton (Nixon, Good Will Hunting), who helped wrestle Sirhan to the ground and disarm him. Plimpton was aided by Olympic gold medalist, Rafer Johnson and professional football player, Rosey Grier. Rosemary Clooney, a strong Kennedy supporter, was also on hand that evening. PHOTOS: Actors Who've Played Politicians The fateful night was immortalized in the 2006 film Bobby, written and directed by Emilio Estevez. The 62-page federal court brief is the latest in a number of appeals filed on Sirhan's behalf, all of which were previously turned down. The Palestinian immigrant hopes to be deported to Jordan and "quietly live out the rest of his life with family and friends," the filing states. "But at long last he would, at least, have received long delayed justice." During his trial, Sirhan admitted that he had killed the Senator "with 20 years of malice aforethought." He later rescinded his confession. The lawyers have asked that the judge set an evidentiary hearing to reexamine the case, stating that Sirhan lacked adequate assistance of counsel during his trial. Golden Globe contenders for television

The Globes get first crack at honoring new fall TV shows, but they come in second to the Emmys when it comes to spring debuts. How will these newbies fare against 'Boardwalk Empire,' 'Good Wife,' 'Modern Family' and 'Glee'?Game of Thrones(HBO)Precursor: "Rome"Why it might: The pay cabler's much-anticipated adaptation of George R.R. Martin's bestselling novels was a big success in the spring, spiking the fantasy milieu with gritty human drama. Then again, the genre isn't for everyone, much less the show's penchant for graphic sex and violence. If not the big one: Viewer favorite Peter Dinklage's portrayal of cagey outsider Tyrion Lannister has already earned him an Emmy.An upbeat opinion: Mary McNamara, Los Angeles Times: "A great and thundering series of political and psychological intrigue bristling with vivid characters, cross-hatched with tantalizing plotlines and seasoned with a splash of fantasy." * * * The Killing(AMC)Precursor: ABC's "Murder One," which initially gambled with the one-case/one-season construct. Why it might: Moody Pacific Northwest atmospherics, a twisty murder and compelling characters added up to a water cooler spring hit for AMC. Then again, red herrings in the plot didn't always please fans; nor did the season-ending episode. If not the big one: Mireille Enos scored as the series' thoughtful, melancholy lead investigator, while Joel Kinnaman as her enigmatic, tart-tongued partner became a fan favorite. An upbeat opinion: Alessandra Stanley, NY Times: "Scary and suspenseful, but in a subdued, meditative way that is somehow all the more chilling." * * * Homeland(Showtime)Precursor: "24" for the propulsive sense of a threat in our midst, mixed with the psychological suspense of "Rubicon."Why it might: A timely show about the cost of hypervigilance in the War on Terror, it combines thriller smarts with acute character study. Then again, the up-and-comer batch of dramas is strong this year, and the popular holdovers ("Boardwalk Empire," "The Good Wife") exhibited tough staying power. If not the big one: Claire Danes, as an intensely committed intelligence analyst, and Damian Lewis, as the returning war hero she suspects of sinister doings, are turning in memorable work week after week.An upbeat opinion: Matt Zoller Seitz, Salon: "The best new show of the fall." * * * Enlightened(HBO)Precursor: A look at the self-destructive side of well-meaning betterment, "Samantha Who" and "The New Adventures of Old Christine."Why it might: Edgy yet empathetic, it reinforces HBO's stature as a place for offbeat, culturally relevant comedy, and offers a killer star turn from Laura Dern. Then again, the humor might be too brittle and dispersed for all tastes -- and it's not always a comedy. If not the big one: It's hard to deny the force of nature that Dern is here, a potent combo of pinwheeling eyes, strategic gamesmanship and hair trigger temperament. An upbeat opinion: Robert Lloyd, Los Angeles Times: "White and Dern might have settled for lampooning a certain strain of spiritual striving and the blindness the convert mistakes for sight. But they're out for something more." * * * New Girl(Fox)Precursor: The twentysomething camaraderie of "Friends," but with the three women concentrated into one kooky charmer. Why it might: Fueled by the star power of Zooey Deschanel's winning lead perf and a blessedly raunch-less approach to dating humor, the show has been the breakout sitcom hit of the fall. Then again, by going for oblong laughs rather than sporty guffaws, it runs the risk of not igniting all tastes. If not the big one: Deschanel is this year's It Girl, fighting the constraints of one-liner sitcom convention with refreshingly off-kilter scene-stealing and a charismatic inner light. An upbeat opinion: Matt Roush, TV Guide: "Everything about 'New Girl,' from her goofy co-stars to the distinctively quirky writing, is irresistible." * * * GOLDEN GLOBES RACETops in tubthumps? Talkback: Who's Willing to Fight for 35mm?

Few Tweeting, iPod-owning, Netflix-streaming, eternally online citizens of the 21st century would lament the advances and conveniences that digital gadgets and technologies afford, but what if you still love that which is made increasingly obsolete? In the film world, that widening gap stands between classic celluloid and digital projection; as studios like 20th Century Fox begin experimenting with digital-only distribution, where does that leave the folks who cherish the magic of watching films on, you know, film? Fox’s recent decision to stop distributing 35mm prints in Hong Kong and Macau may seem like a blip in your news feed happening halfway around the world, but it’s only the beginning of a wider industry phase-out of analog film prints. “The entire Asia-Pacific region has been rapidly deploying digital cinema systems,” said Fox International’s Sunder Kimatrai in August, “and over the next two years we expect to be announcing additional markets where supply of 35mm will be phased out.” Putting it into context closer to home, Julia Marchese of Los Angeles’ New Beverly Cinema — a repertory house that’s been playing double features of 35mm prints since 1978 and is a fixture on the L.A. film scene — took to the internet with a plea to support the ongoing availability of film prints, even as digital measures make increasingly practical sense. The major film studios have decided that they eventually want to stop renting all archival 35mm film prints entirely because there are so few revival houses left, and because digital is cheap and the cost of storing and shipping prints is high. I firmly believe that when you go out to the cinema, the film should be shown in 35mm. At the New Beverly, we have never been about making money — a double feature ticket costs only $8. We are passionate about cinema and film lovers. We still use a reel to reel projection system, and our projectionists care dearly about film, checking each print carefully before it screens and monitoring the film as it runs to ensure the best projection possible. With digital screenings, the projectionists will become obsolete and the film will be run by ushers pushing a button — they don’t ever have to even enter the theater. The human touch will be entirely taken away. The New Beverly Cinema tries our hardest to be a timeless establishment that represents the best that the art of cinema has to offer. We want to remain a haven where true film lovers can watch a film as it was meant to be seen — in 35mm. Revival houses perform an undeniable service to movie watchers — a chance to watch films with an audience that would otherwise only be available for home viewing. Film is meant to be a communal experience, and nothing can surpass watching a film with a receptive audience, in a cinema, projected from a film print. Read the full petition here. There’s no question that going digital is a cost-effective move for studios and theaters alike; so, too, could revival houses like The New Beverly simply install a dual film/digital system to accommodate both formats. That would be fine if the studios controlling vast libraries of catalogue films weren’t planning, eventually, to cease film rentals altogether. Gone will be the “human touch” that Marchese notes, the personal interaction of a trained projectionist sitting above the aisles, in the dark, guiding light through reels of celluloid to the screen. So, too, the lovable imperfections of a print that’s lived, perhaps, longer than you have; the pops, the cracks, the cigarette burns that remind you you’re part of a process of creation, presentation, and response. So, yes; it’s a sentimental argument, not a practical one — though it could be argued that repertory and revival cinema, even in metropolitan hubs like NY, Los Angeles, San Francisco, and Austin, foster a film culture that in turn supports studio catalogue sales on home video and On Demand throughout the land. If a curious neophyte without access to local revival houses downloads a classic film onto their iPod because they read a blog about a screening halfway across the country or the world, hasn’t repertory cinema done its part? (One would hope said hypothetical viewer would eventually watch said film on a proper screen, but you get the point.) Whether you’re a pragmatist or a sentimentalist, if you’re a film fan there’s an argument to be found in favor of keeping 35mm film alive. If you agree, head over to the Fight for 35mm Petition and add your signature. And while you’re at it, check out the upcoming slate of programming at The New Beverly, the American Cinematheque, the Nuart, LACMA, and Cinefamily in Los Angeles; Film Forum, the Walter Reade Theater, and MoMA in NY; the Pacific Film Archive and the Castro Theater in the SF Bay Area; and the Alamo Drafthouse in Austin. (SPOILER: This story consists of the outcomes of Thursdays X Factor elimination). Astro and Stacy Francis were the challengers left to fight it for any just right next days show, but while Stacy got up with singing her song Amazing Sophistication expecting transporting on, if this found the 14-year-old rapper, he was hurt by landing towards the bottom 2 and put his hands as much as carrying out. I truly shouldn't perform. I seem like its unnecessary, but Im gonna let it rest as much as (turns to L.A. Reid), youre my mentor. Do you consider I ought to perform? Astro requested. Youve come a lengthy, lengthy way, L.A. stated. Astro then requested everyone else too if he should rap your final number, which came cheers, so the high-schooler did, spitting out rhymes within the Jackson 5 classic, Never Know Goodbye. Astros self-composed lyrics recommended his amount of time in your competition and that he goes kind words about each one of the idol judges, but he appeared to get rid of his focus throughout the chorus. By comparison, Stacys version of wonderful Sophistication was filled with intonation issues. If this came time for that idol judges election, L.A. and Paula Abdul chosen to get rid of Stacy, while Nicole Scherzinger chosen as well Astro, departing, once more, the ultimate verdict to Simon Cowell, a choice that brought to a different emotional moment once the Brit chastised the youthful guy before a boisterous audience. The way the Dying of Viewer Persistence Is Killing off Newcomer Shows

This story initially made an appearance within the November. 25 problem from the Hollywood Reporter magazine.our editor recommendsThe Digital recording device Dump: 14 Newcomer Shows I am Quitting OnDVR Dump Vol. 2: 10 Newcomer Series I am Keeping10 Television Shows Canceled Faster Than 'The Playboy Club'NBC Shuts Lower Production on 'Prime Suspect'ABC's 'Last Guy Standing' to obtain New Showrunner TNT Cancels 'Men of the Certain Age'NBC Cancels 'Free Agents' Lately, I received three e-mails of note. Two were from producers of series I'd just panned pretty completely, asking me to help keep watching and reconsider. Another was in the mind of the cable funnel mentioning, with all of due respect, why I had been wrong in regards to a certain show and really should stick to it. This isn't unusual. I recieve lots of e-mails and calls from series designers, producers, authors and TV professionals. However in these three situations, the reactions that came immediately in your thoughts were, "Why must I?" and, "Why would anybody expect that?" PHOTOS: Fall TV Dying Pool: Which Shows Is Going To Be Axed First? Honestly, I had been taken aback because of it all. The tv industry nowadays isn't large on second chances. I don't state that dismissively or without empathy concerning the situation: Just because a 500-funnel world is nearer to being true rather than as being a myth, the television viewer is inundated with options. Which means persistence is dead. And at this time within the evolution of television, except inside a couple of very certain situations, maybe that's not this type of bad factor. Competition to have it right the very first time, to become creative and relevant and interesting, is really a prime motivation. It's certainly something people in the industry should know. PHOTOS: TV's Most high-priced Primetime Shows for Marketers You now might expect a tv critic to plead for persistence, to affiliate with the concept creativeness frequently must be nurtured which a variety of great series required some time to obtain there. My reaction to that's: Get a mind in the overall game before someone much like me attempts to chop them back. Perhaps you have -- by you, I am talking about everyone in the industry of creating television -- taken time to meticulously scroll through all the channels you receive in your system, whether it is satellite or cable? If you haven't, you're slacking in your research. And when you've, the very first thought you ought to have had upon concluding that extended process is, "Holy shit, how can i compete within this madness?" PHOTOS: 10 Shows Canceled Faster Than 'Playboy Club' The answer is fairly simple: Make smarter shows. Making them strong from the beginning. That 4th- or fifth-episode stride you're speaking about? That's an illusion. Odds are you're dead at that time, and also you don't have any idea. I only say this particularly for individuals people creating series for that large tent of network television. I simply wiped out these newcomer network shows from my Digital recording device, forever: Last Guy Standing, Not so long ago, Pan Am and Guy Up! from ABC 2 Broke Women, Memorable along with a Gifted Guy from CBS Hart of Dixie, Ringer and also the Secret Circle in the CW Whitney and Prime Suspect from NBC and Allen Gregory from Fox. That doesn't count nixing the already-canceled series. PHOTOS: 10 Showrunners to look at in 2012 Type of a bloodbath. Individuals series are not so good, plus they don't deserve anymore of time. For me personally, it's no problem of whether or not they become hits or whether or not they've been restored. But believe me, this can be a amounts game a huge most of shows aren't winning. Remember when 80 % of newcomer series unsuccessful? We're likely to think about individuals because the traditional days in no time. Last season, ABC offered up 10 new scripted series (including Combat Hospital from Canada). This year, it cut back a couple of individuals. Last season, CBS had eight new scripted series. This year, it cut back three. Fox had seven new scripted series. Additionally, it cut back three (although it did cancel one of these, Breaking In, before apparently altering its mind. I'll accept is as true after i view it on my small TV screen). NBC had 12 new scripted series. It cut back one. With all the added competition this season, what's going to the failure rate seem like whenever we calculate it the next time? The truly amazing mechanical hope here -- the 2nd chance, of sorts -- may be the Digital recording device. Live-plus-same-day, -three-day and -seven-day results can breathe new existence right into a series when Nielsen tallies time-moved audiences. But when your show is lousy, it'll get erased. On cable, there's been a pattern of persistence the broadcast systems aren't permitted. Some of it originates from individuals who purchase Cinemax or Showtime or Starz -- they're likely to be more prepared to keep biting in the bait before you hook them -- and the other part originates from ad-supported cable channels like Forex and AMC producing the kinds of series that float around within the zeitgeist longer. But don't get cocky. Persistence for the reason that medium doesn't take from the facts of competition and price analysis. Forex canceled Terriers and Lights Out. AMC canceled Rubicon. TNT canceled Males of the Certain Age. Things I desired to tell the 3 individuals who sent individuals e-mails pointed out above, requesting second chances, was: "Pretend you're not in the industry -- you're employed a normal job. You may've got a household. You've real-world problems, stresses, time issues. During the night, you've got a window to look at some television and relax and become entertained. With the options before you, how patient will you be?" Not so, is my prediction. Related Subjects Not So Long Ago Ringer A Gifted Guy Pan Am Prime Suspect Whitney

Chaske Spencer, 'Twilight' Wolfpack Leader, on Rachelle Lefervre, Getting Body body fat and Saying Goodbye to 'Twilight'

Prepare to find out 'Twilight' hunk Chaske Spencer in the brand-new light -- everybody's favorite wolfpack leader packed round the pounds for his role inside the approaching flick 'Winter in the Blood stream,' after which it needed his new use a greater level with the help of a mullet for the equation for 'Desert Cathedral.' But don't worry, 'Twilight' fans Spencer can be as aficionado and mullet-free of course inside the lengthy looked forward to 'Breaking Dawn' obligations, where he reprises his role as peaceful pack leader Mike Uley. Moviefone taken track of Spencer to discuss in the infamously intense workout programs with Rachelle Lefervre (as well as the vomiting that ensued) to how he constructed 'Twilight' co-star Julia Manley (who plays Sam's ex, Leah Clearwater) along with his jiggly new stomach. How has your existence changed since becoming connected with 'Twilight'? It's changed pretty drastically. My face is on bubblegum wrappers now! I've had plenty of surreal moments. It's just amazing to behave that's part of a well known culture phenomenon. I still haven't wrapped my thoughts around it. Throughout your surreal moments, are you currently presently particularly starstruck by anybody? Snoop Dogg. And Jackie Chan. I used to be very starstruck by all of them. MTV Worldwide had me work the red-colored-colored carpet just like a correspondent for your MTV Movie Honours, therefore i arrived at meet everybody and interview them. It absolutely was really awesome. The thing that was it like filming 'Breaking Dawn'? I recently spoken together with your co-star Tinsel Korey (Emily), and he or she mentioned it absolutely was kind of bittersweet as it is going to an finish. It's like visiting a party. Each side finish. It was not bittersweet personally. I'd already mentioned my goodbyes throughout my very own approach to the 'Twilight' experience. I'd an enjoyable experience, made some good pals. I'll always take all people recollections with me at night. Arrived to go to. You're the best option in the wolf pack. Have you need to get familiar with the difficult group workout programs? Yeah. We really glued inside the workout programs. It was good casting, everyone was a great fit for people roles. We'd great chemistry. It was not that challenging the level of smoothness of Mike once i was with people males. They're like my brothers and sisters. Once I was speaking with Tyson Houseman (Quil), he stated there's even some vomiting through the workout programs. Ok 4g iphone! I won't title names, but there has been a couple of individuals who did vomit. And That I have arrived at admit that we came pretty close to vomiting too. They were really tough workout programs. What moves triggered people to vomit? It's just that you're working out so desperately, the dangerous chemicals are released within your muscles when you're working them. We barely had breaks between circuits, as well as the body's not familiar with that. If you push it so desperately, it will react but that's what went down. It absolutely was an unusual feeling. Who's probably the most effective? Probably Alex. But I am unsure. Bronson's pretty strong. Things are dependent round the weight you carry. Many of us are pretty strong. Not Rachelle Lefervre? He's a real jokester. He's an excellent guy. He's very talkative, friendly. He can't sit still, so he's always doing such things as throwing a football or doing movies and stuff. Doing movies?! Yep, movies. In my opinion he's a gymnast, and he's also into fighting styles so they can perform a numerous movies and sky kicks and mid-air body twists. [Laughs] It absolutely was really entertaining between takes. Perhaps you have experienced public with Taylor when he's been mobbed by fans or paparazzi? Only one time. After lunch we came outdoors which we've got hit by paparazzi. It absolutely was really strange. Situation. Anything you hear might be the clicks in the cameras. Taylor handles rid of it. He's a gracious guy. Possibly you've had any encounters with intense 'Twilight' fans yourself? Ok 4g iphone. Boundary issues, this is actually the term. I am unable to enter into it, however i have stood a handful of fan encounters that have been somewhat frightening. A lot of the fans are excellent and possess been really sincere and awesome, there's however been a few who haven't. What can people request? It's really a trying to the touch me factor. I don't enjoy that! [Laughs] What's next to suit your needs after 'Twilight'? Lots of sleep! [Laughs] I'm concentrating on a movie referred to as 'Desert Cathedral.' Then before I used to be concentrating on 'Winter inside the Blood'. I've been busy. I enjoy work. It keeps me from my thoughts. Do you have any dream roles you need to pursue, as being a crazy serial killer or anything such as this? At this time around I'm playing a hick getting a mullet who's an investigator. This is an excellent role. Every role I've done differs. I love that. Hopefully I'll execute a good job those may come start to see the movie. So you aren't receiving typecast? Oh, no. In 'Winter inside the Blood stream,' I truly acquired weight. I ended working out, so my figure is completely overweight. The director wanted to accomplish this for your role. People will definitely see me in the different light! [Laughs] I'm chubby. I enjoy a stomach. With this particular role, I have not lost the burden. I've signed on for the next movie I am getting really fit for, so after this I'm to exercising and achieving the bod back! It's hard, really. If you were getting weight, what were your chosen foods to savor? Oh guy. Pizza Hut. Red-colored-colored Robin. The simple truth is, I merely ate everything, which i simply stopped working out. [Laughs] That's all it absolutely was! It was not nuclear physics. And Julia Manley ['Eclipse'] is at 'Winter in the Blood' with me at night, therefore i actually was revealing my stomach to her. I used to be like touch it! And he or she was like, "Gross, no!" [Laughs] Have a look at Chaske in 'Breaking Beginning Part 1,' which opens on November 18.
