CBS rolls to weekly ratings victory
Freshman powerhouse 2 Broke Girls performed impressively for CBS when it anchored Monday for the first time.
The finale of "Survivor," original episodes of most of its hit shows and a sizable NFL overrun on Sunday lifted CBS to one of the most dominant ratings victories of the season. With many of the top shows on the competition preempted or airing in repeat, the Eye claimed seven of the week's top 10 programs in adults 18-49 -- as well as the top five scripted skeins. CBS wraps fall tied with Fox for the lead among adults 18-49 while holding comfortable leads in its strongest categories -- adults 25-54 and total viewers. While CBS is up slightly across the board, Fox is the only net to improve by double-digit percentages. Looking at the week of Dec. 12-18, Nielsen estimates that CBS averaged a 2.8 rating/8 share in adults 18-49 during primetime, comfortably ahead of NBC (2.0/6) and Fox (1.9/5), with ABC and Univision (both 1.3/4) well behind. CBS also cruised in adults 25-54 (3.8/9 to 2.5/6 for runner-up NBC) and total viewers, where its 11.4 million was nearly as much as the next two nets combined (6.2 million for NBC, 5.6 million for Fox). Highlights for CBS included "2 Broke Girls" (4.2/11 in 18-49, 12.50m), which still performed very well despite airing a half-hour earlier than usual (in place of "How I Met Your Mother"). The net also won in the 9 o'clock hour with "Two and a Half Men" (4.7/11, 14.88m) and "Mike and Molly" (4.0/9, 12.77m). "NCIS" (3.6/10, 19.13m), "Criminal Minds" (3.4/9, 12.88m) and "Person of Interest" (2.8/8, 12.93m) were among the Eye's timeslot-winning dramas, with the last drawing its largest audience since its premiere. And Sunday, following a hugely rated NFL game, "60 Minutes" surged (4.0/11, 18.47m), and "Survivor" (4.0/10, 13.07m) wrapped on par with the show's spring conclusion and down a bit vs. last year's fall finale. NBC was paced by "Sunday Night Football" (6.1/15, 16.58m), though the Baltimore-San Diego match was one of the franchise's least-watched of the season. The net also was boosted by the return of "Fear Factor" (3.5/8, 8.52m), which significantly improved its Monday timeslot and became the net's second strongest entertainment series telecast of the fall in 18-49. Fox was led by Wednesday's episode of "The X Factor" (3.4/10, 10.79m), though the new comedy that followed it, "I Hate My Teenage Daughter" (1.8/5, 5.06m), took a hit in its second week. Net fared better with its Tuesday rookie comedy "New Girl" (3.3/9, 6.82m), again building on its demo lead-in from "Glee" (3.0/8, 7.13m). And ABC, which didn't air any original scripted programs, had a very quiet week, seeing its best numbers from Wednesday spec "Barbara Walters Presents: The 10 Most Fascinating People of 2011" (2.3/6, 8.39m), though the annual event continues to see its popularity wane. ESPN's "Monday Night Football" was below average (3.7/10 in 18-49, 9.88m for St. Louis-Seattle) but was easily the top cable draw of the week. Top entertainment series among young adults were A&E's "Storage Wars" (2.3/6, 5.20m) and "Storage Wars: Texas" (2.1/6, 4.68m), Discovery's "Gold Rush" (2.1/7, 5.38m), History's "Pawn Stars" (2.1/6, 5.23m) and MTV's "Teen Mom" (2.0/5, 3.42m).
Other than "MNF," the most-watched cablecast of the week was Fox News Channel's coverage of the Republican Presidential Debate on Thursday (6.71 million). It drew more viewers than ABC News' "The Year With Katie Couric" special that aired on the same night (5.54m). And on the pay cable side, Showtime was pleased with the numbers for its Sunday finales of "Dexter" (2.23 million) and "Homeland" (1.71m). When you add in a second showing that night, "Homeland's" audience (2.1 million) was the largest to date for the first-season finale of a Showtime series (Daily Variety, Dec. 20). B.O. hosts quiet party for 'New Year's'
'New Year's Eve'A paltry $13.7 million opening for Warner Bros.' "New Year's Eve" party couldn't rouse what is the worst weekend overall at the domestic box office in three years. Overseas B.O. was far less dire, as Paramount-DreamWorks Animation's "Puss in Boots" rallied with a chart-topping estimated $45.6 million. Though the star-powered ensembler still managed to beat 20th Century Fox's new entry "The Sitter," which collected $10 million, Warners expected "New Year's Eve" to hit at around $20 million for the weekend. "The Sitter" performed in line with pre-weekend projections. Stateside B.O., totaling in the mid-to-high-$70 millions, was down even from last weekend's typically sluggish post-Thanksgiving frame, at $81 million. What's more, B.O. conditions haven't been this off since the weekend of Sept. 5, 2008, when overall totals reached just $67.9 million. "It's rare that this week would fall below last weekend," said Warner domestic distribution chief Dan Fellman, who added that big titles launching next weekend, such as "Sherlock Holmes: A Game of Shadows" and "Alvin and the Chipmunks: Chipwrecked," will be an important test for the industry. In advance of overseas school holidays, "Puss in Boots" added 16 territories this weekend, including top market Germany, which contributed $7.2 million. Toon has cumed $142.3 million internationally. While Stateside wide releases mostly fell short, the weekend's crop of specialty titles, led by Focus Features' "Tinker Tailor Soldier Spy," came in strong. "Tailor" scored the year's third-highest per-screen average for a traditional theatrical release, totaling an estimated average of $75,184 from four locations. ("Midnight in Paris" and "The Tree of Life" hold 2011's best per-screen perfs, respectively.) Par, meanwhile, did well with Jason Reitman's black comedy "Young Adult," which launched limited for an estimated three-day gross of $320,000. That's an average of $40,000 from eight engagements. "Young Adult" should have a strong female fanbase, according to Par marketing and distribution head Megan Colligan. That's one reason why Par decided to launch the film limited, before expanding to approximately 1,000 locations next weekend. "It's always tricky with women in the weeks leading up to Christmas," Colligan said. "And with 'Young Adult,' I think it's important that we're not at 3,000 locations next weekend. "This is a film that needs room to grow." By comparison, "New Year's Eve" skewed heavily toward women, which repped 70% of the film's opening. In July, a federal judge turned down Megaupload's motion to dismiss the suit, finding: "Megaupload serves as more than a passive conduit and more than a mere 'file storage' company: It has created distinct Web sites presumably in an effort to streamline users' access to different types of media. It encourages and in some cases pays its users to upload vast amounts of popular media through its rewards programs. It disseminates URLS for various files throughout the Internet. It provides payouts to affiliate websites who maintain a catalogue of all available files and last at a minimum, it is plausibly aware of the ongoing rampant infringement taking place on its Web sites." In September, however, Megaupload settled the lawsuit with Perfect 10. Terms of the agreement haven't been revealed, but the parties submitted a motion so that the judge's July decision would be vacated. Hilary Swank Discusses Her Ill-Fated Trip To Chechnya: I Should Know Where Im Going
Hilary Swank tonight kicked off her image-rehabilitating campaign after the disastrous paid appearance at tyrannical Chechen president Ramzan Kadyrov’s birthday party with a visit to The Tonight Show with Jay Leno. The backlash from the Oct. 5 appearance in Grozny led to Swank firing her manager and most of her agents. The fallout also included her PR firm 42West reportedly dropping her over disagreement how the aftermath of her embarrassing stint should be handled, so it’s unclear who booked her appearance on Leno tonight. In in, Swank tried to repair some of the damage by claiming ignorance. She ultimately took responsibly for her blunder but left some blame for her representatives too. “Human rights organizations had reached out to warn me before I went but I did not get those warnings, they werent shared with me,” she said in a subtle jab at her reps. “The bottom line is I should know where I’m going and should do better research.” Watch Swank’s account of the events in the video clip below. Curiously, the clip stops just before the end of the conversation, which, in typical Leno fashion didn’t include a single tough question. In the left-out part, after talking about how little she knew about Chechnya and its government before the incident and how much she has learned since, Swank said, “I actually didnt know that Chechnya was separate from Russia.” The statement is somewhat puzzling because, while being its own republic, Chechnya is still a member of the Russian Federation.

Melrose II fund sues Paramount over profits
The Melrose II fund co-financed several Paramount pics, including the 'Transformers' franchise.Investors in Melrose II, a fund which co-financed Paramount pics including the "Transformers" franchise, have sued the studio over profits to several films. Filed today in Los Angeles Superior court, the suit seeks to recover profits related to a nearly $375 million investment in 29 films dating back to 2006. Suit, which also name DreamWorks as a defendant, points to pics including "Mission Impossible 3," "Charlotte's Web," "Dreamgirls," "Flags of Our Fathers," "Blades of Glory," "Jackass 2" and all three "Transformers" films. While the lawsuit does not specify a dollar amount, the contested money is believed to total in the tens of millions. Documents allege that since inking a deal with the studio five years ago, financiers have not yet seen a profit on their investment. The complaint alleges that those investors were entitled to a a 25% copyright interest in up to 30 films and agreed to fund a "pro rata" amount of the production costs. "Melrose II is an important investor and copyright owner and we're going to fight to make sure that they get their fare share of these profits," Kirkland & Ellis LLP's Mark Holscher told Variety. The firm is representing the Melrose II group, which is mainly comprised investors based in NY.
"On Melrose Avenue, at the oldest existing film studio in Hollywood, Paramount Pictures Corporation routinely calculates 'net receipts' to take in huge returns on one set of books while reporting losses to its profit participants on another," the suit alleges. This is not the first time investors have accused the studio of Hollywood accounting. In 2008, a number of investors from the studio's Melrose I financing vehicle sued the studio for securities fraud and are currently seeking about $30 million in damages. In newly filed court documents obtained by the AP, Sirhan Sirhan's legal team allege that a bullet was switched in evidence at his trial, and that Sirhan was hypnotized to fire shots as a diversion from the actual killer. The lawyers, William F. Pepper and Laurie Dusek, also claim that new audio tests from the 1968 assassination prove that there were 13 shots fired from multiple guns -- five more than Sirhan could have fired from his pistol. In the original trial, eight bullets were counted. Three hit Kennedy, and the rest struck five other victims who were able to recover. Talkback: Who's Willing to Fight for 35mm?
Few Tweeting, iPod-owning, Netflix-streaming, eternally online citizens of the 21st century would lament the advances and conveniences that digital gadgets and technologies afford, but what if you still love that which is made increasingly obsolete? In the film world, that widening gap stands between classic celluloid and digital projection; as studios like 20th Century Fox begin experimenting with digital-only distribution, where does that leave the folks who cherish the magic of watching films on, you know, film? Fox’s recent decision to stop distributing 35mm prints in Hong Kong and Macau may seem like a blip in your news feed happening halfway around the world, but it’s only the beginning of a wider industry phase-out of analog film prints. “The entire Asia-Pacific region has been rapidly deploying digital cinema systems,” said Fox International’s Sunder Kimatrai in August, “and over the next two years we expect to be announcing additional markets where supply of 35mm will be phased out.” Putting it into context closer to home, Julia Marchese of Los Angeles’ New Beverly Cinema — a repertory house that’s been playing double features of 35mm prints since 1978 and is a fixture on the L.A. film scene — took to the internet with a plea to support the ongoing availability of film prints, even as digital measures make increasingly practical sense. The major film studios have decided that they eventually want to stop renting all archival 35mm film prints entirely because there are so few revival houses left, and because digital is cheap and the cost of storing and shipping prints is high. I firmly believe that when you go out to the cinema, the film should be shown in 35mm. At the New Beverly, we have never been about making money — a double feature ticket costs only $8. We are passionate about cinema and film lovers. We still use a reel to reel projection system, and our projectionists care dearly about film, checking each print carefully before it screens and monitoring the film as it runs to ensure the best projection possible. With digital screenings, the projectionists will become obsolete and the film will be run by ushers pushing a button — they don’t ever have to even enter the theater. The human touch will be entirely taken away. The New Beverly Cinema tries our hardest to be a timeless establishment that represents the best that the art of cinema has to offer. We want to remain a haven where true film lovers can watch a film as it was meant to be seen — in 35mm. Revival houses perform an undeniable service to movie watchers — a chance to watch films with an audience that would otherwise only be available for home viewing. Film is meant to be a communal experience, and nothing can surpass watching a film with a receptive audience, in a cinema, projected from a film print. Read the full petition here. There’s no question that going digital is a cost-effective move for studios and theaters alike; so, too, could revival houses like The New Beverly simply install a dual film/digital system to accommodate both formats. That would be fine if the studios controlling vast libraries of catalogue films weren’t planning, eventually, to cease film rentals altogether. Gone will be the “human touch” that Marchese notes, the personal interaction of a trained projectionist sitting above the aisles, in the dark, guiding light through reels of celluloid to the screen. So, too, the lovable imperfections of a print that’s lived, perhaps, longer than you have; the pops, the cracks, the cigarette burns that remind you you’re part of a process of creation, presentation, and response. So, yes; it’s a sentimental argument, not a practical one — though it could be argued that repertory and revival cinema, even in metropolitan hubs like NY, Los Angeles, San Francisco, and Austin, foster a film culture that in turn supports studio catalogue sales on home video and On Demand throughout the land. If a curious neophyte without access to local revival houses downloads a classic film onto their iPod because they read a blog about a screening halfway across the country or the world, hasn’t repertory cinema done its part? (One would hope said hypothetical viewer would eventually watch said film on a proper screen, but you get the point.) Whether you’re a pragmatist or a sentimentalist, if you’re a film fan there’s an argument to be found in favor of keeping 35mm film alive. John Dunning, Canadian Film Pioneer, Dies at 84
John Dunning, a co-founder of Canada's pioneering Cinepix film company who helped jump-start the careers of David Cronenberg and Ivan Reitman, died Sept. 19 in Montreal after a long illness, Lionsgate Entertainment announced Thursday. It grossed $43 million in North America after Paramount picked it up for distribution. With Dunning and Link still at the helm, Cinepix, which also owned a NY distribution arm and a controlling interest in an animation house, was purchased in 1997 by Lions Gate and renamed Lions Gate Films. In 1962, Dunning -- who at age 17 took over the family's small exhibition business when his father died suddenly -- and Link produced their first movie, Valerie, a sexy comedy that earned more than $1 million at the box office and held the Quebec box office record for three decades. It was one of the sexploitation films (in Canada, a genre known as "maple syrup porn") for which Cinepix would first gain notoriety. The company also specialized in horror films, and Cinepix produced two early Cronenberg features: 1975's They Came From Within (also known as Shivers) and 1977's Rabid (also known asRage), starring Marilyn Chambers. "John Dunning is the unacknowledged godfather of an entire generation of Canadian filmmakers," Cronenberg said in June when the Toronto Film Critics Association honored the producer. "I still consider him my movie mentor." Dunning and Link hired Reitman in 1974, and he produced such Cinepix films as Death Weekend (1976), Ilsa, Tigress of Siberia (1977) and Blackout (1978) before scoring big with Meatballs, the summer-camp comedy starring Bill Murray. Denys Arcand, Don Carmody, Larry Kent and Vincent Gallo were among other filmmakers that were nurtured by the company. Dunning also produced or executive produced such films as The Mystery of the Million Dollar Hockey Puck (1975), Death Weekend (1976), My Bloody Valentine (1981) and Buffalo '66 (1998). More recently, he executive produced the Bloody Valentine remake in 2009. Dunning and Link were honored at the 1993 Genie Awards for their outstanding contributions to the business of filmmaking in Canada and in 2007 were inducted into the Canadian Film and Television Hall of Fame. Survivors include his wife Jean; son Greg and daughter-in-law Bonnie; and grandchildren, Lia and John. A service is set for 1 p.m. Sept. 30 at the Mount Royal Funeral Complex in Outremont, Quebec.
